On 21 May 2011, the NSW Coalition Government released details on the implementation of its Strategic Regional Land Use Policy which the Coalition announced it would introduce when it was in opposition.
The implementation of the Government’s Policy will include:
- a sixty (60) day moratorium on the granting of new coal, CSG and petroleum exploration licences in NSW;
- a requirement that all applications for coal, CSG and petroleum exploration licences be exhibited for public comment;
- the impact on strategic agricultural land from development activities will be subject to public notification requirements;
- all new coal, CSG and petroleum extraction applications must be accompanied by an Agricultural Impact Statement;
- new regulations will be introduced to adopt a range of measures to better regulate activities that impact on aquifers.
The NSW Government is expected to release further details, not only in relation to the Government’s regulation of fraccing (see our article on the Regulation of Hydraulic Fracturing), but also in relation to exploration licences generally this year.
